Dan Bitting and John Hicks prevailed in the appeal of their trial court victory in a legal malpractice suit. The plaintiff sued two attorneys for legal malpractice and breach of fiduciary duty in connection with the lawyers’ handling of a divorce and a related lawsuit. In 2008 Bitting and Hicks won summary judgment for their clients in the trial court and plaintiff appealed. On August 12, 2010 in a unanimous opinion the Austin Court of Appeals affirmed the judgment in favor of Bitting’s and Hick’s clients.
