Jane Webre and Chris Sileo Win Appeal Entitling Electric Company to Multi-Million Dollar Energy Efficiency Bonus from the Public Utility Commission

SD&M lawyers Jane Webre and Chris Sileo were part of a team that recently won an appeal from an order of the Texas Public Utility Commission. The Third District Court of Appeals determined that the PUC improperly reduced a performance bonus owed to a unit of CenterPoint Energy Inc. after it spent a substantial sum implementing successful energy efficiency programs. The Court said that in calculating the payment owed to CenterPoint under an agency rule incentivizing energy efficiency, the PUC incorrectly excluded funds the utility agreed to invest in energy savings projects under a separate settlement agreement. CenterPoint is entitled to an additional bonus each year for the 4 years it performed under the settlement. CenterPoint was also represented in the appeal by its general counsel Jason M. Ryan as well as Christian J. Ward and Ryan P. Bates of Yetter Coleman LLP. Jane Webre argued the case in the Court of Appeals. The opinion can be found here.
