Dan Bitting and Cindy Connolly Win Appeal Allowing Marina Development to Proceed

Dan Bitting and Cindy Connolly recently prevailed in an appeal before the Austin Court of Appeals, preserving their trial court victory in an important property rights dispute. In October 2010, Dan and Cindy won a trial court judgment finding that their client’s property on Lake Travis was not subject to any restrictions prohibiting commercial use, which meant that their client could use the property for a marina. The opposing landowner appealed. On May 18, 2012, the Austin Court of Appeals affirmed the judgment in favor of Dan and Cindy’s client in all respects. The case was Diane Crumley Dee v. Crosswater Yacht Club, LP; No. 03-10-00796-CV in the Third Court of Appeals in Austin, Texas. The victory will enable the multi-million dollar marina development to proceed.
