Firm Files Amicus Brief on Behalf of Bipartisan and Bicameral Texas Delegation Urging United States Supreme Court to Halt Nuclear Waste Dump atop the Permian Basin

On January 22, Scott Douglass & McConnico filed an amicus brief on behalf of Texas members of Congress – Senators John Cornyn and Ted Cruz, and Representatives Henry Cuellar, Jodey Arrington, August Pfulger, and Ronny Jackson. In Nuclear Regulatory Commission v. Texas, the Supreme Court is considering whether the Nuclear Regulatory Commission properly licensed a facility in Andrews County, Texas to store thousands of tons of highly radioactive spent nuclear fuel—waste from nuclear reactors—in the heart of the country’s most prolific oil-producing region.

The brief explains that Congress never authorized the Commission to allow private facilities to centralize and indefinitely store the country’s spent fuel. And the brief explains that the licensed facility’s Andrews County location presents an enormous threat to the country’s security and economic well-being because the Permian Basin fuels the country’s economy and safeguards the country’s strategic energy independence.
